To the fullest extent permitted by applicable law, the Operator, its officers, directors, employees, agents, affiliates, successors, and assigns shall not be liable for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages, including damages for loss of profits, goodwill, data, or other intangible losses, arising out of or in connection with: the collection, use, disclosure, retention, or processing of Information as described in this Policy; any unauthorized access to, disclosure of, alteration of, or destruction of Information; any failure or breach of security measures; any reliance on this Policy or any changes to this Policy; or any other matter relating to the privacy or security of Information, regardless of the theory of liability (whether in contract, tort, strict liability, or otherwise) and regardless of whether the Operator was advised of the possibility of such damages.

14. Governing Law and Dispute Resolution

This Policy shall be governed by, construed in accordance with, and interpreted under the laws of the jurisdiction in which the Operator is domiciled, without regard to conflict of laws principles. Any dispute, claim, or controversy arising out of or relating to this Policy, or the collection, use, or handling of Information, shall be resolved exclusively through binding arbitration administered in accordance with the rules of a nationally recognized arbitration organization, as selected by the Operator in its sole discretion. You agree to waive any right to participate in a class action, class-wide arbitration, or any other representative proceeding with respect to any claim arising under or related to this Policy.

16. Severability

If any provision of this Policy is held to be invalid, illegal, or unenforceable by a court or tribunal of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions of this Policy shall continue in full force and effect. The invalidity or unenforceability of any provision in one jurisdiction shall not affect the validity or enforceability of that provision, or of the remaining provisions, in any other jurisdiction.

17. Entire Agreement

This Policy, together with any other legal notices, terms, and policies published on the Site, constitutes the entire agreement between you and the Operator with respect to the subject matter hereof and supersedes all prior or contemporaneous communications, understandings, representations, and agreements, whether written or oral, relating to the privacy practices described herein.

18. Waiver

The failure of the Operator to enforce any right or provision of this Policy at any time shall not constitute a waiver of such right or provision. Any waiver of any provision of this Policy shall be effective only if in writing and signed by an authorized representative of the Operator. A waiver of any right or provision on one occasion shall not be deemed a waiver of such right or provision on any subsequent occasion.

19. Survival

The provisions of this Policy that by their nature should survive termination of your use of the Site, including Sections 3, 4, 5, 6, 7, 10, 13, 14, 16, 17, 18, and this Section 19, shall survive and remain in full force and effect after the cessation of your use of the Site, for any reason.

20. Interpretation

In this Policy, unless the context otherwise requires: (a) the words "include," "includes," and "including" shall be deemed to be followed by the phrase "without limitation"; (b) the words "such as," "for example," and similar phrases shall be construed as illustrative and not limiting; (c) headings and section titles are for convenience of reference only and shall not affect the interpretation of this Policy; (d) references to "applicable law" include all laws, statutes, regulations, ordinances, rules, orders, decrees, judgments, and directives of any governmental authority that we determine, in our sole judgment, to apply to the relevant circumstances; (e) the use of the singular includes the plural and vice versa; (f) references to "days" mean calendar days unless otherwise specified; and (g) references to "writing" or "written" include electronic communications and digital records.
